NOTICE OF PRIVACY PRACTICES

1. OUR LEGAL DUTY

We are required by law to:

  • Maintain the privacy of your protected health information (PHI), whether electronic, paper, or oral.

  • Provide you with this Notice of Privacy Practices (NPP) describing how we may use and disclose your PHI.

  • Follow the terms of this NPP.

  • Notify you if there is a breach of your PHI.

We are required to comply with HIPAA and federal SUD confidentiality regulations (42 CFR Part 2). We may change this NPP at any time; the updated NPP will be posted in the office and on our website.

2. HOW WE MAY USE AND DISCLOSE YOUR PHI

We may use or disclose your PHI without your written authorization for the following purposes:

A. Treatment

  • Sharing information with yourself, other health care providers, or clinics for your care.

B. Payment

  • Billing, claims, insurance verification, and collection activities.

C. Health Care Operations

  • Quality improvement, risk management, audits, compliance, and legal requirements.

D. Public Health and Safety

  • Reporting required communicable diseases or public health threats.

E. Law Enforcement or Legal Requirements

  • Complying with court orders, law enforcement requests, or legal investigations.

F. Substance Use Disorder (SUD) Records

  • Protected under 42 CFR Part 2.

  • Disclosure requires written consent unless otherwise permitted by law.

  • SUD records cannot be redisclosed without written permission.

G. Other Uses

  • Research, workers’ compensation, or any other use requires written authorization.

3. YOUR RIGHTS REGARDING PHI

As a patient, you have the right to:

  1. Access and Copy Your PHI

    • Request to inspect or obtain a copy of your records.

  2. Request an Amendment

    • Ask us to correct or add information if you believe your PHI is incorrect or incomplete.

  3. Request Restrictions

    • Limit use or disclosure of PHI for treatment, payment, or operations.

    • We are not required to agree to all restrictions but will honor any we accept.

  4. Request Confidential Communications

    • Ask for alternate methods or locations for communication.

  5. Receive an Accounting of Disclosures

    • Request a list of PHI disclosures for purposes other than treatment, payment, or operations.

  6. Receive a Paper Copy of This Notice

    • Even if you previously received it electronically, you may request a paper copy.

  7. File a Complaint

    • If you believe your privacy rights have been violated, contact the Privacy Officer (below) or file a complaint with HHS OCR.

    • No retaliation will occur for filing a complaint.

5. CHANGES TO THIS NOTICE

6. ACKNOWLEDGMENT OF RECEIPT

I acknowledge that I have received and read the Notice of Privacy Practices for Heins Chiropractic. I understand that I may ask questions about the content of this notice at any time.
